Steven Avery, whose incarceration was the subject of Netflix's hit series Making a Murderer, has won the right to appeal his conviction, the BBC reports. Avery is currently serving a life sentence for the 2005 murder of photographer Teresa Halbach.

He claims innocence and is now asking to have his case reexamined by a Wisconsin court after it emerged that bones believed to be in possession of the Wisconsin Department of Justice and said to be Halbach's had been returned to the woman's family without DNA testing, which Avery's lawyer Kathleen Zellner claims is a violation of state law.

Halbach's charred remains were found at Avery's car salvage yard a week after she visited to photograph a minivan. Avery and his nephew Brendan Dassey were both convicted for Halbach's killing in separate trials in 2007.
